Win the Ultimate Prom Contest Rules
1. How to Enter the Contest:
a. The “WIN THE ULTIMATE PROM” contest will begin on Friday, October 1, 2010 and end at midnight on Tuesday, November 30, 2010. b. To participate in the contest, participants must
register to vote online at WintheUltimateProm.com. To vote for a school, participants should visit WintheUltimateProm.com starting at 12:00 am on Thursday, Friday, October 1, 2010. Registered participants are allowed to
vote once daily within the promotion period of 10/01/10 – 11/30/10. Participants may vote online. The grand prize will be awarded to the high school with the highest number of submitted votes. The grand prize will be a $25,000.00 donation in value. The winning schools will receive the grand prize in the Spring of 2010. Odds of winning depend on number of votes received. Past grand prize winners are not eligible to win the $25,000 grand prize within two consecutive years.
2. Rules and Regulations
a. The rules and regulations of this contest are subject to change without notice. b. Eligibility is limited to accredited public or private high schools located in the United States. c. The winning high schools will be announced on the week of December 15, 2010. A representative of the school will be officially notified no later than Friday, December 18, 2010. d. Award is non-transferable. e. School student body, school faculty, friends and family may vote once daily for the school of their choice. f. The $25,000 dollar donation will be awarded to the school that has received the highest number of votes during the promotion period beginning 10/01/10 thru 11/30/10. g. By voting in the “WIN THE ULTIMATE PROM” contest, you agree to all terms of the contest and you are giving your permission to be contacted by VERGO Marketing, Inc. and its affiliates by phone, mail or email. i. The winning schools must meet all eligibility requirements and must agree to use the grand prize toward the 2011 Junior/Senior Prom or any other school-related event. j. The grand prize is not subject to any refund and shall bear no cash value. The grand prize is non-exchangeable and nontransferable. k. Neither VERGO Marketing, Inc., nor its affiliated sponsors will be responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technical difficulties or for any medical emergencies which may interrupt or prevent participant from voting in the promotion. l. No purchase necessary. Limit one vote per day per person.
3. Eligibility Restrictions:
a. The contest is open to all high school students, faculty and their affiliated friends and family over the age of 13 years. b. Participants may only cast their vote for one school. Participants can then vote for that school once a day during the promotion period of 10/01/10 thru 11/30/10. Participants may not change their selected school once they have registered at WintheUltimateProm.com. c. To vote online you must enter your first name and last name, complete address, city, state, zip code, home telephone number, valid e-mail address, date of birth, year of graduation, school of attendance and school you are voting for. Internet entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
4. Selection of Winner:
a. The winning school must be an accredited public or private high school located in the United States. b. The school receiving the highest number of votes within the promotion period beginning 10/01/10 thru 11/30/10 will be declared the grand prize winner. The final vote tally will be conducted by VERGO Marketing, Inc. and/or its representatives or affiliates. All decisions of VERGO Marketing, Inc. and/or its representatives or affiliates with respect to the contest are final.
5.Conditions:
a. Payment of all federal, state and local taxes are the sole responsibility of the winning schools. The winning schools will be required to sign an IRS Form 1099 or the equivalent. b. By participating in the contest, the winning school agrees to have their school name and/or representatives used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize. c. The winning school will be required to sign a Winners Release and Assignment prior to acceptance of any prize. Pursuant to the Winners Release and Assignment, the winning school will agree to hold VERGO Marketing, Inc. affiliated officers, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or contest. d. Before prize will be awarded, you must provide: • Proof of eligibility or accreditation • A valid taxpayer identification number or social security e. VERGO Marketing, Inc. reserves the right to deny awarding the prize should the winning school fail to meet the eligibility requirements, as determined by VERGO Marketing, Inc. at their sole discretion. f. All federal, state and local taxes (including any sales taxes) are the sole responsibility of the winning school. g. Failure to comply with the contest rules may result in a schools disqualification. h. Copies of the written contest rules are available during regular business hours at the VERGO Marketing, Inc. offices located at 1375 N. Scottsdale Road, Suite 340, Scottsdale, AZ 85257. i. Participants voluntarily provide personally identifiable information for the purpose of voting for the school of their choice in “WIN THE ULTIMATE PROM” promotion, that specific information will be supplied directly to the third parties involved with “WIN THE ULTIMATE PROM”. While VERGO Marketing, Inc. will seek to require that any such third parties will follow the appropriate privacy policies and will not authorize them to use any part of this information except for the express purpose for which it was provided, VERGO Marketing, Inc. does not bear any responsibility for any actions or policies of any third parties. j. Winning School must return completed 1099 along with Winners Release and Assignment within 90 days of notice of winning. If the required documents are not received within 90 days of receiving notice to VERGO Marketing at 1375 N. Scottsdale Road, Suite 340, Scottsdale, AZ 85257, school will forfeit prize.
